The EU has issued a notice of initiation of an anti-dumping proceeding concerning imports of certain hot-rolled iron flat products. Also, non-alloyed steels or other allied steels, originating in Brazil, Iran, Russia, Serbia and Ukraine (2016/C 246/08).
The European Commission has received a complaint under Article 5 of Council Regulation (EC) No. 1225/2009 of November 30, 2009. Regarding protection against dumped imports. From countries that are not members of the European Community (1) (hereinafter referred to as the basic regulation). In which it is claimed that imports of certain hot-rolled flat products. Which are originally from Brazil, Iran, Russia, Serbia and Ukraine. And they are subject to dumping which causes significant damage to the industry in the Union.
The complaint was filed on May 23, 2016 by the European Steel Association (Eurofer) on behalf. Of producers representing more than 25% of the Union’s total production of certain hot-rolled flat products.
The subject of this investigation is certain flat-rolled products of iron, non-alloy steel or other alloy steels (except stainless steel), whether or not in rolls (including products cut to length and „narrow strips”).
The presumption of dumping in Brazil, Iran, Russia and Ukraine is based on a comparison between the domestic price and the export price (ex-factory level). Of the product that is the subject of the investigation, when it is sold for export to the Union.
The plaintiff brought evidence that imports of the products that are the subject of the investigation from the countries in question have increased globally. Both in absolute terms and in terms of market share.
The evidence provided by the plaintiff shows that the volume and prices of the imported product that is the subject of the investigation. They had, among other consequences, a negative impact on the quantities sold, the level of prices charged. Also, the market share held by industry in the Union. Having as a result significant negative effects on the overall performance, financial situation and employment of the industry in the Union.
